1. OUR COMMITMENT TO PRIVACY

INDUSTRIE Australia is committed to protecting the privacy and security of personal information.

This Privacy Policy explains how INDUSTRIE Australia and its U.S. affiliates and related entities ("we", "us" or "our") collect, use, disclose, retain and protect personal information when individuals interact with us in the United States.

Our U.S. operations are based in Nevada, and we operate and sell to customers throughout the United States.

This Privacy Policy applies to information collected through INDUSTRIE Australia retail stores, websites and online stores, purchases, payments, returns and exchanges, INDUSTRIE INSIDER and other loyalty programs, in-store customer sign-ups, email and SMS communications, customer service, competitions, promotions, giveaways and events, social media, cookies, pixels and similar technologies, and other interactions with INDUSTRIE Australia.

INDUSTRIE Australia complies with applicable U.S. federal and state privacy, consumer protection and marketing laws. Where a state privacy law applies, residents of that state will receive the rights provided under that law.

2. PERSONAL INFORMATION WE COLLECT

Depending on how you interact with INDUSTRIE Australia, we may collect:

Contact and identification information, including name, email address, mobile or telephone number, billing address, shipping address, customer account information and loyalty membership details.

Purchase and transaction information, including products purchased, purchase amounts, transaction dates, store or sales channel, payment transaction information, returns, refunds, exchanges, gift cards, coupons, promotional offers, loyalty rewards, rewards earned and redeemed, and purchase history.

Online and device information, including IP address, browser type, device type, device identifiers, operating system, pages viewed, products viewed, links clicked, referring website, shopping activity, website interactions, cookie identifiers, advertising identifiers, approximate location based on IP address, and interactions with advertisements or marketing.

Marketing information, including email and SMS marketing preferences, product interests, communication preferences, engagement with emails and SMS, responses to advertising and promotions, loyalty activity and customer preferences.

Customer service information, including enquiries, complaints, faulty products, returns, refunds, exchanges, delivery issues and correspondence with INDUSTRIE Australia.

CCTV and store security information may also be collected for safety, security, loss prevention, fraud prevention, incident investigation and protection of customers, employees and property.

Payment card information may be processed directly by our payment providers and will not be stored directly by INDUSTRIE Australia.

3. HOW WE COLLECT INFORMATION

We may collect information directly from you when you purchase a product, place an online order, make a return or exchange, create an account, join INDUSTRIE INSIDER, provide details to a team member in store, subscribe to email marketing, separately consent to SMS marketing, enter a promotion or competition, scan an INDUSTRIE Australia QR code in store, contact customer service, interact with us on social media or otherwise provide information to us.

We may also collect information automatically through websites, cookies, pixels and similar technologies, and from service providers and business partners that assist us with ecommerce, point-of-sale systems, payments, delivery, marketing, loyalty programs, analytics, fraud prevention, advertising, social media and customer service.

4. HOW WE USE PERSONAL INFORMATION

We may use personal information to process purchases and payments; fulfil orders; arrange deliveries; process returns, exchanges and refunds; provide customer service; respond to enquiries and complaints; create and administer customer accounts; operate INDUSTRIE INSIDER; calculate, issue and redeem loyalty rewards; issue gift cards and promotional offers; prevent fraud and theft; maintain store and website security; communicate about orders and accounts; provide marketing where permitted; personalise customer experiences; understand customer preferences; analyse purchasing behaviour; improve products, services and websites; measure marketing and advertising performance; administer promotions, competitions and events; perform business analysis; maintain appropriate records; comply with legal obligations; protect INDUSTRIE Australia's legal rights; and carry out other purposes disclosed when information is collected.

5. INDUSTRIE INSIDER LOYALTY PROGRAM (Instore Only)

INDUSTRIE Australia may operate customer loyalty programs, including INDUSTRIE INSIDER.

When a customer joins INDUSTRIE INSIDER, we may collect and use information including name, email address, mobile number if provided, purchase history, transaction value, returns and exchanges, rewards earned, rewards redeemed, membership information and marketing preferences.

This information may be used to identify members, administer membership, calculate qualifying spend, issue and redeem rewards, prevent misuse of rewards, communicate membership information and provide member benefits.

Participation in INDUSTRIE INSIDER is voluntary.

A customer does not have to agree to receive SMS marketing in order to become an INDUSTRIE INSIDER member or make a purchase. Email and SMS marketing choices will be handled separately where required.

6. CALIFORNIA NOTICE OF FINANCIAL INCENTIVE

INDUSTRIE INSIDER may provide members with rewards, discounts, vouchers, benefits, promotional offers or other incentives in connection with participation in the program and the personal information used to administer it.

Where required by California law, INDUSTRIE Australia will provide a separate Notice of Financial Incentive at or before enrolment.

The notice will explain the material terms of the program; the categories of personal information involved; the benefits provided; how the incentive relates to the value of the information to INDUSTRIE Australia; how a customer may opt into the program; and how a customer may withdraw from the program.

Participation is voluntary. A member may withdraw from INDUSTRIE INSIDER in accordance with the program Terms and Conditions and applicable law. Withdrawal may result in closure of the loyalty account and cancellation of unused loyalty rewards or benefits, subject to applicable law and the INDUSTRIE INSIDER Terms and Conditions.

7. IN-STORE SIGN-UP

Customers may be enrolled in INDUSTRIE INSIDER by an INDUSTRIE Australia team member at a participating store.

At or before enrolment, customers will be provided with access to applicable INDUSTRIE INSIDER Terms and Conditions, this Privacy Policy and, where required, the California Notice of Financial Incentive.

Joining INDUSTRIE INSIDER does not automatically constitute consent to receive SMS marketing. Where marketing consent is required, customers will be provided with an appropriate choice. SMS marketing consent will be obtained separately from loyalty membership where required by law.

8. EMAIL MARKETING

Customers may choose to receive marketing emails from INDUSTRIE Australia. Marketing emails may include new products, promotions, offers, store events, store openings, loyalty information, rewards, competitions and INDUSTRIE Australia news.

Marketing emails will provide an unsubscribe method. Customers may unsubscribe from commercial marketing emails at any time, and INDUSTRIE Australia will process valid unsubscribe requests in accordance with applicable law.

Unsubscribing from marketing does not prevent INDUSTRIE Australia from sending necessary transactional or service communications relating to orders, deliveries, payments, returns, refunds, account security or customer service requests.

9. SMS MARKETING

INDUSTRIE Australia will obtain the consent required by applicable law before sending marketing SMS or automated promotional text messages.

Where required, SMS consent will be clear and conspicuous, affirmative, separately captured and recorded.

Consent to receive marketing SMS messages is not a condition of purchasing goods or services from INDUSTRIE Australia or joining INDUSTRIE INSIDER.

By providing the required consent, a customer authorises INDUSTRIE Australia to send marketing text messages to the mobile number provided. Message frequency may vary. Message and data rates may apply.

Customers may revoke SMS marketing consent at any time using a reasonable opt-out method.

INDUSTRIE Australia may send a one-time non-promotional confirmation of an SMS opt-out where permitted by law and may maintain records of SMS marketing consent and opt-out requests where appropriate.

10. COOKIES, PIXELS AND SIMILAR TECHNOLOGIES

INDUSTRIE Australia and our service providers may use cookies, pixels, tags, local storage, analytics tools and similar technologies to operate our websites, maintain shopping carts, remember preferences, enable customer accounts, understand website activity, analyse performance, prevent fraud, personalise content, measure marketing and advertising, and provide or measure advertising.

Third-party technologies may include services provided by ecommerce, analytics, advertising, social media and marketing providers.

Customers may manage certain technologies through browser controls and any cookie or privacy preference tools INDUSTRIE Australia makes available. Disabling some technologies may affect website functionality.

11. TARGETED ADVERTISING, SALE AND SHARING

INDUSTRIE Australia does not sell personal information for monetary payment.

However, some U.S. state privacy laws use broad definitions of "sale", "sharing" or "targeted advertising". As a result, disclosure of online identifiers or other information to certain advertising, analytics or social media providers may be considered a sale, sharing or targeted advertising activity under applicable law even when no money is exchanged.

Where required by law, INDUSTRIE Australia will provide customers with the ability to opt out of sale, sharing for cross-context behavioural advertising, and processing for targeted advertising.

12. DISCLOSURE TO SERVICE PROVIDERS AND THIRD PARTIES

We may disclose personal information to companies that assist INDUSTRIE Australia in operating our business, including payment processors; banks and financial institutions; ecommerce platforms; point-of-sale providers; customer database providers; loyalty providers; email and SMS providers; customer service providers; cloud hosting and IT providers; cybersecurity and fraud prevention providers; analytics, marketing and advertising providers; social media platforms; fulfilment providers; warehouses; freight providers; courier companies; insurers; accountants; auditors; lawyers; and other professional advisers.

Where appropriate, INDUSTRIE Australia requires service providers to handle personal information for authorised purposes and in accordance with applicable contractual and legal obligations.

13. LEGAL AND SECURITY DISCLOSURES

INDUSTRIE Australia may disclose personal information where reasonably necessary or appropriate to comply with law; respond to legal process or lawful government requests; cooperate with regulators or law enforcement; investigate fraud or theft; enforce agreements; protect legal rights; or protect customers, employees or the safety and security of our business.

14. SENSITIVE PERSONAL INFORMATION

INDUSTRIE Australia does not generally require sensitive personal information from retail customers.

Where we collect sensitive personal information, we will use it only for appropriate purposes and in accordance with applicable law. Where an applicable state law provides a right to limit certain uses or disclosures of sensitive personal information, INDUSTRIE Australia will provide that right where required.

INDUSTRIE Australia does not use sensitive personal information to infer characteristics about customers except where permitted by law.

15. CHILDREN'S PRIVACY

Our websites and general retail services are not directed to children under the age of 13.

We do not knowingly collect personal information online from children under 13. If we become aware that personal information has been collected from a child under 13 in circumstances where parental consent was required, we will take appropriate steps to delete or otherwise address that information.

16. DATA SECURITY

INDUSTRIE Australia uses reasonable administrative, technical and physical safeguards designed to protect personal information against loss, misuse, unauthorised access, unauthorised disclosure, alteration and destruction.

Measures may include access controls, passwords, encryption where appropriate, firewalls, anti-malware controls, network monitoring, employee training, physical security, restricted system access and security policies and procedures.

No method of transmission or storage is completely secure, and INDUSTRIE Australia cannot guarantee absolute security.

17. PAYMENT SECURITY

Payments may be processed by third-party payment providers. INDUSTRIE Australia seeks to use payment systems and providers that maintain appropriate payment security standards. Complete payment card information may be processed directly by payment providers rather than stored by INDUSTRIE Australia.

18. DATA RETENTION

INDUSTRIE Australia retains personal information only for as long as reasonably necessary for the purpose for which it was collected or for legitimate business and legal requirements.

Factors that may affect retention periods include transaction records, tax and accounting requirements, loyalty memberships, customer service, returns, fraud prevention, dispute resolution, contractual requirements, regulatory requirements and legal claims.

When personal information is no longer reasonably required, INDUSTRIE Australia will delete, destroy, de-identify or otherwise dispose of it where appropriate and legally permitted.

19. DE-IDENTIFIED AND AGGREGATED INFORMATION

INDUSTRIE Australia may create aggregated or de-identified information for business analysis, forecasting, customer insights, product planning, marketing analysis and operational improvement.

Where information is maintained as de-identified information, INDUSTRIE Australia will not attempt to re-identify it except where permitted by law.

20. U.S. STATE PRIVACY RIGHTS

Depending on where you reside and whether the relevant state privacy law applies to INDUSTRIE Australia, you may have rights to confirm processing; access personal information; request information about information collected; correct inaccurate information; request deletion; obtain a portable copy; opt out of sale, sharing or targeted advertising; opt out of certain profiling; limit certain uses of sensitive personal information; withdraw consent where applicable; and appeal certain decisions.

INDUSTRIE Australia will not unlawfully discriminate against an individual for exercising an applicable privacy right. Rights vary by state and are subject to applicable exemptions.

21. CALIFORNIA PRIVACY RIGHTS

Where the California Consumer Privacy Act, as amended (CCPA), applies to INDUSTRIE Australia, California residents may have rights including:

Right to Know: You may request information about the personal information INDUSTRIE Australia has collected about you and how it has been used or disclosed.

Right to Access: You may request access to specific personal information maintained about you, subject to applicable exceptions.

Right to Correct: You may request correction of inaccurate personal information.

Right to Delete: You may request deletion of certain personal information, subject to applicable exceptions.

Right to Opt Out of Sale or Sharing: You may opt out of the sale or sharing of personal information where those terms apply under California law. INDUSTRIE Australia does not sell personal information for monetary payment. Certain advertising or analytics disclosures may nevertheless fall within broader California definitions of sale or sharing.

Right to Limit Certain Uses of Sensitive Personal Information: Where applicable, you may request limits on certain uses or disclosures of sensitive personal information.

Global Privacy Control: Where required, INDUSTRIE Australia will recognise qualifying Global Privacy Control signals as an applicable request to opt out of sale or sharing for the browser or device transmitting the signal.

Non-Discrimination: INDUSTRIE Australia will not unlawfully discriminate against California consumers for exercising CCPA rights.

Loyalty and Financial Incentives: INDUSTRIE Australia may offer benefits through INDUSTRIE INSIDER. Where required by the CCPA, customers will receive a Notice of Financial Incentive at or before opting into the applicable loyalty arrangement.

22. NEVADA PRIVACY RIGHTS

INDUSTRIE Australia's U.S. operations are based in Nevada.

Where Nevada privacy law applies, Nevada consumers may submit a verified request directing INDUSTRIE Australia not to make a covered sale of covered information as those terms are defined by Nevada law.

INDUSTRIE Australia will process qualifying Nevada requests in accordance with applicable law.

23. OTHER U.S. STATE PRIVACY RIGHTS

Residents of other U.S. states may have privacy rights under the laws of their state. Where those laws apply to INDUSTRIE Australia, we will provide the rights required by applicable law, which may include rights relating to access, correction, deletion, portability, targeted advertising, sale, profiling, sensitive information and appeals.

24. IDENTITY VERIFICATION

To protect customer information, INDUSTRIE Australia may need to verify your identity before processing certain privacy requests.

We will request only information reasonably necessary to verify the request. The verification method may depend on the type of request, the sensitivity of the information, whether you have an account and the information INDUSTRIE Australia already maintains.

If we cannot reasonably verify a request, we may be unable to fulfil it.

25. AUTHORISED AGENTS

Where permitted by applicable law, you may appoint an authorised agent to make a privacy request on your behalf.

INDUSTRIE Australia may require appropriate evidence that the agent is authorised to act for you and/or that you have verified your identity directly with INDUSTRIE Australia. We will not require additional information beyond what is permitted by applicable law.

26. PRIVACY REQUEST APPEALS

Where applicable state law provides a right to appeal a decision relating to a privacy request, INDUSTRIE Australia will provide instructions on how to submit an appeal. Appeals will be considered and responded to within the period required by applicable law.

27. INTERNATIONAL DATA TRANSFERS

INDUSTRIE Australia operates as part of an international business. Personal information may be processed, stored or accessed by related entities, employees or service providers located outside the United States, including in Australia and other jurisdictions.

Where required by applicable law, INDUSTRIE Australia will take appropriate measures relating to international processing or transfer of personal information.

28. THIRD-PARTY WEBSITES AND SERVICES

Our websites may contain links to third-party websites or services. INDUSTRIE Australia does not control the privacy or security practices of independent third parties. Customers should review the privacy policies of third-party websites and services before providing information to them.

29. CHANGES TO THIS PRIVACY POLICY

INDUSTRIE Australia may update this Privacy Policy from time to time to reflect changes to our business, stores, services, technology, data practices or applicable law.

The updated Privacy Policy will display an updated "Last Updated" date. Where required by law, INDUSTRIE Australia will provide additional notice of material changes.
